Pixel Problems: What Hospitals Need to Know About Tracking Technologies

Overview 
OHA has been made aware of law firms contacting hospital patients alleging that hospitals are using website tracking tools that jeopardize the safety of their patient data. These firms are seeking participants in class action lawsuits against hospitals, and this activity appears to be increasing across the country. At the same time, the Office for Civil Rights at the U.S. Department of Health and Human Services recently issued a bulletin to highlight the obligations of HIPAA-covered entities and business associates (“regulated entities”) under the HIPAA Privacy, Security, and Breach Notification Rules when using online tracking technologies. Many hospitals are using online tracking technologies in their public websites and patient portals and should be aware of this guidance and the legal implications. This webinar will review the guidance, discuss current litigation and provide practical tips to hospitals to help navigate these technologies.
